This Terms of Use Agreement sets forth the standards of use of the C1 Truck Driver Training, LLC Online Service. By using the C1training.com website you (the “Member”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at C1training.com website. Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.

Description of Service

C1 Truck Driver Training, LLC is providing Member with access to online driver recruitment and cdl training information. Member must:

• Provide all equipment necessary for their own Internet connection, including computer and modem.
• Provide for Member’s access to the Internet.
• Pay any fees related to with such connection.

Eligibility and Age Restrictions

The website and services provided by C1 Truck Driver Training LLC are intended solely for individuals who are at least 18 years of age and capable of entering into legally binding contracts. We do not knowingly collect, solicit, or maintain personal information from children under the age of 18. If you are under 18 years of age, you are strictly prohibited from accessing, using, or submitting personal data to this website.

Disclaimer of Warranties

The site is provided by C1 Truck Driver Training, LLC on an “as is” and on an “as available” basis. To the fullest extent permitted by applicable law, C1 Truck Driver Training, LLC makes no representations or warranties of any kind, express or implied, regarding the use or the results of this web site in terms of its correctness, accuracy, reliability, or otherwise. C1 Truck Driver Training, LLC shall have no liability for any interruptions in the use of this Website.

Binding Arbitration and Class Action Waiver

Any arbitration hearing shall take place exclusively in Marion County, Indiana, unless both parties mutually agree in writing to an alternative location. Arbitration shall be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You and C1 Truck Driver Training, LLC explicitly agree that each may bring clais against the other only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Indemnification

Member agrees to indemnify and hold C1 Truck Driver Training, LLC, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Member’s use of the Service, the violation of this Agreement, or infringement by Member, or other user of the Service using Member’s computer, of any intellectual property or any other right of any person or entity.

Modifications and Interruption to Service

C1 Truck Driver Training, LLC reserves the right to modify, amend, or update these Terms of Use at any time. When material changes are made, we will update the “Effective Date” at the top of this page and provide reasonable notice on our website. Your continued access to or use of the website after thirty (30) days following the posting of updated terms constitutes your binding acceptance of the revised Terms of Use.

Member expressly agrees to be contacted by C1 Truck Driver Training, LLC at any phone number or email address provided by Member to C1 Truck Driver Training, LLC through its website(s). C1 Truck Driver Training, LLC may communicate with Member regarding the Member’s application for admittance into the C1 Training and Placement Program or any other future training or employment opportunity which C1 believes may be of interest or value to the Member.

Member further agrees that C1 Truck Driver Training, LLC may use SMS (text) messages, automatic telephone dialing systems or pre-recorded messages in connection with calls or messages sent to any provided telephone number or email address, even if assigned to a cellular telephone service.

Member further acknowledges that agreeing to the terms in this section is not a requirement of purchasing or receiving any property, goods or services from or through C1 Truck Driver Training and that such consent may be revoked by Member at any time by communicating such revocation to C1 Truck Driver Training by submitting a request directly to the company at privacy@c1training.com or by calling toll-free at 1-866-822-9805.

Other Terms

If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by C1 Truck Driver Training, LLC, in our sole discretion, to a third party in the event of a merger or acquisition.

This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Member. Member agrees that by accepting this Terms of Use Agreement, Member is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement.
